TERMS AND CONDITIONS
This agreement contains the entire understanding between 'The Photographer' Lee Parkinson Photography and 'The Client'.
1. CONFIRMATION
The official confirmation would be met once the booking form has been completed and a 25% of the total cost retainer has been paid (non-refundable) This will be deducted from the total cost of the agreed/chosen packaged. By completing the booking form and paying the retainer confirms I have read and fully understand the terms of the agreement between myself 'The Client' and 'The Photographer'.
2. PRICES/PAYMENTS
All photographic services and optional extras specified in this contract are to be paid in full before the wedding date. Goods not specified on the booking form are supplied at the prices ruling at the time of receipt of the order. Titles to all goods remains with the photographer until paid for in full by the client(s). Additional goods ordered must be paid for in full at the time of ordering.
3. OWNERSHIP:
All digital negatives (computer files) remain the property of the photographer.
4. CANCELLATION:
In the event that The Client should have to cancel a booking up to three months before the wedding, the initial 25% retainer cannot be refunded as the covers any work carried out by The Photographer which would include but not limited to marketing activities, phone calls and emails with The Client and preparations for the wedding date.
Cancellation within less than three months to go until the wedding date would result in full price. The client(s) are hereby advised to take out an appropriate insurance policy to cover any expenses incurred in the event of a cancellation.
5. FORCE MAJEURE:
The photographer will assist the client(s) to get intouch with another photographer in the event they are unable to attend on the wedding date due to any cause beyond their reasonable control e.g. sudden illness, injury, victim of crime, flooding etc. However it may prove difficult or impossible to find a skilled replacement photographer at such short notice or at the same price.
In the event of cancellation by the photographer, liability shall be limited to a full refund of any fees paid.
6. COOPERATION:
The Client and The Photographer consent to cheerfully cooperate and communicate with each other to achieve the best possible results within the understanding of this contract. It would be recommended that The Photographer is provided with a helper (usually the best man) whom could/shall assist point out key individuals to be photographed. The Photographer may also require the assistance of the best man (or whomever chosen) in organising family groups. The Client also agrees to give The Photographer sufficient warning of key events at the wedding to give The Photographer time to prepare e.g. Bouquet throwing, cutting the cake, speeches etc. Please note that not all guests at weddings like having their photo taken. In such cases The Photographer shall use his discretion but cannot be held responsible for a lack of photographs of these people.
7. WEDDING GUESTS PHOTOGRAPHING:
Many of your guests may have digital cameras and may want to photograph the bride and groom. In the spirit of cheerful cooperation The Client agrees to give The Photographer precedence over your guests in order to take the photographs required for the wedding services described above.
The Photographer cannot be held liable for a lack of wedding photographs if The Photographer’s work has been continually interrupted by guests taking their own photographs of the bride and groom.
8. DISPLAY:
The Client hereby allows The Photographer to display any photograph covered by this contract and to generally promote the business in advertising, brochures, magazine articles, websites, sample albums and prints, venue and other vendor samples, and other such material, providing that the images used are used lawfully and without damage to The Client.
9. COMPLAINTS:
Any complaints must be received in writing within 7 days of receipt of products purchased (including digital products). This includes photographs, discs, albums, frames and any other services that have been agreed.
10. REPLACEMENT PRODUCTS:
Regarding the The Client’s wedding package of all edited images, The Client is advised to make a backup copy. The provision of additional copies of such images by The Photographer shall incur further charges to cover costs (time, materials, postage etc) at the prevailing rate at the time of request.
11. PERSONAL ACCDIENT:
The photographer will not knowingly put any persons at risk. Any directions issued to clients, their guests or employees during a photographic shoot are deemed to be at said persons own risk. The photographer cannot be held responsible for any personal accidents during a photographic shoot.
